Two men were sentenced to two years probation today for raping a 14-year-old girl. Tony Pacheco (left), 17 at the time of the 2006 crime, and Angel Alverio (right), then 18, pleaded guilty yesterday to one count each of aggravated battery and criminal sexual abuse. The were sentenced to 24 months probation and both have to register as sex offenders for 10 years.

After Alverio and Pacheco allegedly made contact with the victim through MySpace...they arranged a July 24 meeting. They then drove her to a house in the 4800 block of West Walton, the home of a 15-year-old boy, [assistant state's attorney John] Henning said.At the boy's home, they "drank alcohol and played video games," Henning said. Chicago Police Officer JoAnn Taylor said the group consumed "a large amount of alcohol."
The girl "became ill, and that is when she was sexually assaulted multiple times by the offenders," Taylor said.
After the drinking, the girl passed out. When she awoke, Pacheco allegedly was having sex with her, according to Henning. She passed out again and woke up to find the 15-year-old having sex with her. After losing consciousness a third time, the girl awoke to find Alverio attempting to receive oral sex from her, Henning said.
The next thing she knew, the 14-year-old woke up in an alley about two miles away at 3253 W. North, where a passerby found her around 3 p.m., Taylor said. The girl was treated at Norwegian American Hospital and released.
The then-15-year-old also pleaded guilty. [S-T]



So sexual assault doesn't get them any jail time. God. They would have received harsher sentences for simply possessing pot.
Yes, but there really isn't a powerful anti-sexual assault lobby to push for mandatory minimums. And, of course, much of the U.S. population will ignorantly assert that the girl was asking for it.
These Chicago judges are terrible! How can they honestly not give these rapists jail time?!

And in 10 years, when they aren't dangerous sexual predators anymore (due to some kind of wonderful magic we'll discover in the intervening decade) they'll be completely free of the consequences of their actions.

as disgusted as I am that there is no jail time and saddened that sexual assault of a 14 year old girl is 'not so bad' to incur said jail time - I was still surprised when I read the rest of the article.
the then 15-year old got 5 years of probation. So why is it the then 17 and 18 year olds only get two for the exact same offense? Apparently the younger kid should have known better than the older kids. He should have set the example!

as much as these cases are shitty, the prosecutor clearly did not have a good case, had a bad victim and cut the best deal they could. it happens.

Your use of the phrase "bad victim" makes me really hope you're never a victim yourself. The fact she might have been traumatized by being repeatedly assaulted by this ambulatory filth should not stand in the way of carrying out the law.
Judges have a great deal of say in sentencing, they don't have to take these deals and they don't have to accept PROBATION for multiple felony rape. That judge should be out on his or her ear. And the D.A who brokered such a deal.

It is practically next to impossible to get a rape case to the point of conviction.
And 'bad victim' might be a sad way of looking at it, but unless you are pretty much white, a virgin, pure as the driven snow, virtuous and really got beat up bad so you had a lot of scenic bruising, then your chances of getting a conviction are slim to none.
Talk about judges...there are judges in this country who will not even allow the prosecutors to use the word 'rape' in their courtrooms because they don't want anything that looks prejudiced against the perp. Oh...and they won't allow anything like 'sexually assaulted' either, so you end up using words like 'was penetrated' which really ends up making the whole ordeal look tame.
Also, it usually takes up to 2 years or more to even get a rape case to court. That's pretty frustrating and tiring for the victim/survivor of the rape. The whole system is set up for the attacker and definitely not the victim/survivor.
From the actual attack, to what goes on in the ER directly following the attack and then the court system. It's all like getting raped over and over again.

The amount of outrage here should be applied to ALL rape cases that are prosecuted because inevitably they end up more similar to this than not.
To pretend like this was a specific outcome because of a "kangaroo court" judge or prosecutor is naive.
