Mette Conviction Overturned

2008_10_01_mette.jpgYesterday, we looked at the Windy Citizen's interview with Chicago Police officer Michael Mette, serving a five-year prison term in Iowa for assault stemming from a 2005 fight. This morning, the Iowa Court of Appeals overturned Mette's conviction. The Court of Appeals agreed with Mette's contention that he acted in self-defense, saying:

After being pushed and knocked backward two or three times, there was nothing in the record to indicate Michael could have avoided Gothard's next blow, without his defensive punch...While it may be possible to speculate on Michael's ability to retreat, the record is utterly void of any testimony to support that assumption.
No man is above the law, but the five-year sentence seemed harsh for the crime.
