Remember the Roscoe's/Rosscoe's House of Chicken and Waffles kerfuffle from last year that had readers quoting lines from "Coming to America?" Looks like we're about to see it again, only with Superdawg in the role of plaintiff.
Superdawg has filed a lawsuit against a Greewnich Village hot dog joint, claiming that Danny Omari's use of "SuperDog" was grounds for trademark infringement. Superdawg co-owner Scott Berman, who's also the restaurant's general counsel, wasn't happy with Omari's decision to alter his restaurant to "Super Hot Dog."
All we know is that we're hitting up Omari's shop the next time we're in New York.

This isn't quite as strong as the Rosscoe's/Roscoe's one. The question is, will a person in NY think this is the same Superdawg, especially considering they're spelled differently AND he changed the name? Furthermore, does Superdawg have a national presence? Unless there's more to this, this is a loser of a case.
I don't think it's about whether or not they have a national presence -- they have a federally registered trademark. While they may be overreacting a bit in this instance, the law is set up to make trademark holders a bit paranoid about defending their trademark, as not going after infringement can possibly lead to them losing the registration.
