Inherit the Windbag: Defense Rests In Blago Case? (UPDATED)

By Marcus Gilmer in News on Jul 20, 2010 8:37PM

According to Fox Chicago [h/t Robert Loerzel], the defense in the Rod Blagojevich case has rested with only Robert Blagojevich testifying. We thought this had to be a mistake so we swung by the Sun-Times' blog on the case (which has been stellar) and all they have is that Robert finished testifying and that a sidebar has been called. We're awaiting word on more details. It seems impossible that the defense would rest without calling any other witnesses, even if they decided that Rod wouldn't testify.

We also thought there was some Rod/Rob confusion but another detailed report on Fox Chicago says that Rod's defense has rested, too, even as Judge Zagel has said, "Not now."

Update: Judge Zagel has accepted the request and we could go to closing arguments this week.

Update: At a press conference just now, Robert's attorney Michael Ettinger said he rested his case, "contingent upon" Rod's defense team's plans to not call any witnesses.

Update: The Sun-Times is now reporting sources as backing up the claim that Rod won't testify and that the defense could rest without calling a single witness though, as Sam Adam Sr said, “Nothing is a certainty.”
