1 Of The 2 Cops At The Scene Of Chatman's Fatal Shooting Will Be Tried

A judge has dismissed the case against one of the two Chicago police officers involved in the fatal 2013 shooting of unarmed 17-year-old Cedrick Chatman.

U.S. District Court Judge Robert Gettleman dismissed the suit against Officer Lou Toth, who was at the scene but didn’t shoot Chatman, according to ABC7. A lawsuit remains against Officer Kevin Fry, the shooter. Both lawsuits were filed by Chatman’s mother.

Fry shot Chatman during a foot chase, which the city released surveillance footage of a week ago. He and Toth were pursuing Chatman because he was a suspect in a car theft.

Fry has said he shot Chatman because he thought Chatman was armed and turning to shoot at the officers. Really, Chatman was holding an iPhone box in his hand.
