Following his DUI arrest, Walter Jacobson told the Trib that "I believe, and my attorney believes, that I am innocent."
According to Jacobson's attorney, "Our investigation to this point shows that Walter hasn't hit anybody and didn't cause any accident. He wasn't driving a car while under the influence." Oh, Skippy. [Trib, S-T]

I like how the attorney says:
"Our investigation to this point shows that Walter hasn't hit anybody and didn't cause any accident. He wasn't driving a car while under the influence."
with the subtle implication of this:
"Our investigation to this point shows that Walter hasn't hit anybody and didn't cause any accident therefore, he wasn't driving a car while under the influence and even if he was, who cares because he didn't hit anybody and didn't cause any accident."

I'd say the combination of a BAC of .092, a fucked up front bumper that corroborates the eyewitness account of a crash, a prior record of the same crime, and an eyes-glassy-as-fuck mugshot is enough proof of his guilt for me. Case closed.
I think they're going to go for "you can't prove he was driving." He wasn't in the car at the time of the arrest.
