Update On Dad Who Duct Taped Daughter And Posted Photo on Facebook

The story of the young Chicago dad who taped up his daughter and posted the photo to Facebook has gone national, and the man's attorney says the father is devastated. Andre Curry, 21, could face jail time because he decided to wrap his toddler daughter up with blue painters tape (earlier reports said it was duct tape) after she was playing with it. He posted the photo to Facebook with the caption "This is wut happens wen my baby hits me back. ;)"

Curry is in prison on $100,000 bond, currently charged with felony aggravated domestic abuse. A judge ruled Wednesday that he may not have contact with his 22-moth-old daughter or anyone else under the age of 18. Curry's lawyer says the internet has blown the whole story out of proportion. CNN writes:

"The photo itself does not tell the story of who our client is and how well he takes care of this child," said [Curry's public defender Anand] Sundaram.

He said his client will not face the felony charge if prosecutors cannot prove the girl suffered any injuries from the incident. If that's the case, he said, prosecutors could at most seek a charge of misdemeanor battery.

The toddler is being examined by a doctor today for any signs of abuse. Curry does not have any previous charges of child abuse or any criminal background at all. A family member defended Curry to the Tribune.

"He's so playful, always laughing," said the woman, who would not give her name. "Everyone who knows him saw the photo and laughed, too … He was only joking."

She also said he knows what he did was a mistake and he "feels awful," especially now that the photo has gone viral on the Internet.

The story is getting the talking-head treatment from the 24-hour news networks now, and in the piece from CNN Headline News below, you can see they are not being so kind to Curry.

  • I don't think this dude needed to be arrested and charged over this.  Investigated, sure, but straight up arrested? Really?  

     I have a photo of my 4 month old son in a stew pot, and another of my daughter in a roasting pan, but that doesn't mean I actually cooked them.  It was just a goofy thing I did cuz at the moment it seemed like a funny idea, even if it was of questionable taste.

    Hey Chicagoist, I know you are just trolling for comments but I think its reprehensible that you are still using the phrase "Duct Taped" when  the Trib article you link to, other contemporary media reports, and the police report acknowledge that it was only PAINTERS' TAPE.

    This is just stupid. The guy was messing around with his kid. It's freaking painters tape. Everyone that's taking issue with this needs to take a step back and think of what they've done with their own kids that may have been funny at the time, but someone who just walked into the room might find questionable. This is just another way for the bored people of this country to get up on a soapbox. and being that a large number of people are off work for the holidays, they've got a bit of extra time.

    I'm going to take a wild stab in the dark here and say you don't have any kids.  However, if you do...  I'm sure we'll be reading about their appallingly cruel antics on these pgs in the next 13+ yrs.

    Not nearly as stupid as this guy. What about his comment 
    "This is wut happens wen my baby hits me back. ;)" Aside from the obvious lack of basic English, isn't he saying that he hits his child? And then duct-tapes her when she tries to defend herself? You really don't see anything wrong with that?

    i really can't tell if you're trolling or you legitimately have no sense of humor. does that kid look likes she's crying or struggling in any way?

    She can't cry or struggle because she's bound and gagged. That's not something normal parents do and is not psychologically healthy for young children.

    However it could be normal if the dad was playing Cop vs Thief (which is a very popular kid game btw). Until we hear the story from the daughter point of view, anything we say here is just speculation.
